Drug Offences in Malaysia

Drug offences in Malaysia carry some of the harshest penalties in our legal system, and defending them requires a drug lawyer who understands how these cases are built, investigated and prosecuted.

At Read & Co Law, we represent individuals facing drug charges, general criminal matters and preventive detention issues, providing clear guidance from the earliest stages of arrest and investigation.

Our drug offense lawyers combine prosecution and defence experience to identify weaknesses in the evidence, challenge procedural errors and build strategies that protect your position.

We assess the facts, review the investigation process and tailor our defence strategies to the circumstances of each client.

Whether you are dealing with drug possession, trafficking allegations or general crime charges, our team is equipped to handle complex situations with structured preparation and strategic intervention.

Why Drug Cases Demand Specialist Defence

Serious Penalties & High Risk

Drug offences in Malaysia carry heavy consequences. Long mandatory prison terms, potential capital punishment  and other severe outcomes in trafficking cases make it essential to have a drug lawyer who understands how these matters are handled from the word go.

Complex Investigations & Legal Nuances

When it comes to drug cases, small procedural details often decide the case. How substances are seized, tested and documented can change the entire outcome. The chain of evidence makes or breaks the prosecution’s case. A drug offence lawyer must know how to spot issues in procedure or evidence and use them to your advantage.

Prosecution vs Defence Perspectives

Our team has worked on both sides of the criminal spectrum, giving us insight into how investigators and prosecutors build up and present drug cases. This helps our criminal defence lawyers see weaknesses early and plan an effective defence.

Types of Drug Offence Cases We Handle

Drug possession Drug trafficking & distribution
Illegal import/export of controlled substances Drug manufacture / chemical-based offences
Seizure of assets linked to drug crime Bail and remand matters in drug cases

Accused of drug possession, trafficking or other drug-related offences in Malaysia? These charges carry severe penalties such as long imprisonment, caning or even the death penalty in trafficking cases.

At Read & Co Law, our drug offence lawyers combine prosecution-side insight and defence experience to build early interventions, challenge evidence and fight for your rights with clarity and resolve.

Common Questions on Drug Offences (FAQ)

The cost of a drug lawyer in Malaysia depends on a multitude of factors. The two biggest factors relating to cost are seriousness of the charges and whether you intend to contest the charges by going to trial, or pleading guilty. The costs may range from RM5,000 – RM200,000.

The punishment for trafficking in drugs currently is either a mandatory sentence of imprisonment for life (30 years) or to death by hanging.

Possession of a substance entails proof of one having custody or control of a substance coupled with knowledge of the thing possessed. Substantive defences usually turn on these questions of fact and law.

The presumption of trafficking can be rebutted by either contesting and successfully casting doubt on the issue of possession or by going the other way to convince the trier of fact that the drugs in question are kept for the purpose of self-administration only (eg. Buying in bulk)

Any lawyer you choose to engage must be able to explain to you your prospects of success honestly and as they are, whether those prospects are not what you want to hear. Be wary of parties who offer “guarantees” as the party offering said guarantees are either proposing to engage with corruption or are otherwise scammers, since it is a judge who will be deciding your case, and not the lawyer. With that caveat in mind, go with whoever you feel the most comfortable with in terms of shared values and sensibilities.
